In September 2009, the Foundation, along with several other organizations, filed an amicus curiae (friend-of-the court) brief to the Tenth Circuit Court of Appeals detailing how it would negatively affect private organizations, businesses and local governments if Osage County were deemed a “reservation”.

In March of this year, the Tenth Circuit upheld a ruling from the U.S. District Court for the Northern District of Oklahoma concluding that the Osage reservation had been disestablished by Congress, thus negating the Nation’s case.  The Nation filed for a rehearing en banc, meaning a rehearing with all of the Tenth Circuit justices.  That motion was denied.  The final legal avenue left for the Nation is to appeal to the U.S.  Supreme Court.
