| Eminent domain lawsuit protects ag land |
In one of the Foundation’s biggest victories to date, on May 9, 2006, the Oklahoma Supreme Court came back with a favorable opinion in Board of County Commissioners of Muskogee County v. Lowery, 2006 OK 31. The court held that the takings of the Landowners’ private property to confer a private benefit on a private party, Energetix, was in violation of Article 2, §§ 23 & 24 of the Oklahoma Constitution.

| Intervention in NRDC case against EPA |
On March 24, 2006, the District Court in Maryland entered an order approving the settlement in the Natural Resources Defense Council (NRDC) atrazine Endangered Species Act case. OFB joined in an action with several other state Farm Bureaus and commodity organizations to intervene in a lawsuit brought by the NRDC which sought an injunction against the EPA to ban the use of atrazine.

| Beef checkoff litigation |
On May 23, 2005, the U.S. Supreme Court held that the beef checkoff program does not violate certain beef producers’ First Amendment rights to free speech.

| Seminole annexation |
Private property rights received a strong boost and the Foundation won a huge victory when the Oklahoma State Supreme Court reversed a lower court decision and ruled municipalities cannot annex land without having a reasonable purpose.

| Listing of the Mountain Plover under the Endangered Species Act |
The mountain plover (Charadrius montanus) was proposed for listing as a threatened species under the Endangered Species Act in 1999. The Foundation provided legal comments and used an expert bird biologist to comment on the U.S. Fish and Wildlife Service's (Service) proposed listing.

| Fencing along railroad right-of-ways |
The Foundation successfully assisted a member in going through the administrative process with the railroad and the Oklahoma Corporation Commission to get fence replaced along the railroad right-of-way.
